What's the difference between a contractor and an EOR employee?
A contractor runs their own business and invoices you. An EOR employee works for Employ Latam (legally) and is assigned to you. Contractors are cheaper and faster to start, but the wrong choice for full-time, exclusive, scheduled work. That counts as misclassification in most LATAM countries, and several enforce it actively.
When should we convert a contractor to an employee?
When the contractor works only for you, has set hours, follows your processes, and uses your tools, they are effectively an employee under most LATAM labor law. We can help you convert with minimal disruption: same person, same pay, same start of next month, just on an Employ Latam employment contract instead.
How does the FX work?
You pay us in USD (or send us a local-currency invoice if you prefer). We pay the contractor in their chosen currency. The rate is shown in your dashboard before you approve, so you can see the converted amount upfront.
Do you handle tax withholding?
Yes, where local rules require it. Several LATAM countries require withholding on service payments to individuals. We calculate, withhold, and remit; the contractor gets a receipt they can use as a credit on their own tax return.
Can contractors be paid in USD instead of local currency?
Yes, if they prefer. Many LATAM contractors prefer USD for inflation-protected savings. We can pay USD into a local USD account, a Wise account, or USDC if they want crypto settlement. Same monthly fee either way.
What about the year-end tax statement?
Each LATAM country has its own year-end form for contractor income. We generate the right one for each contractor and email it to them by the local deadline. You get a consolidated report for your own records.
